GiftGrab Official Rules
Last updated: [publication date]. This is a translation; in case of doubt the German version prevails.
Important notice first
We expressly point out: we are not obliged to give you anything or to pay anything out.
- GiftGrab is a free game. All cash and voucher prizes and any thank-you bonus are paid exclusively from ad revenue or by partner companies.
- Few visitors mean little revenue. No revenue means no cash prizes and no thank-you bonus.
- Whether there are prizes, and which ones, is decided before the start of each month and announced in the app. Only these announced prizes are awarded.
- There is no entitlement to prizes, bonus payments or any particular amount, not even with high visitor numbers.
- Donated items come from other users, not from us. We only connect people.
1. Organiser and scope
- The organiser of GiftGrab (German name „Greifkiste“) and of all prize draws is [name, address, email] (the "Organiser"), operator of DuelFriends and Offerfisher.
- These rules apply to the game, to adding items and to all prize draws in it. They supplement the general terms and conditions. Where they conflict, these rules prevail.
- By playing for the first time or adding an item, the participant accepts these rules.
2. Participation and game coins
- Natural persons aged 18 or over who live in [Germany / the EU] may take part.
- Taking part costs nothing. The game is played with game coins only. Game coins cannot be bought, sold, transferred or exchanged for money.
- Game coins are given, for example, as a starting balance or voluntarily for watching an ad. The chance of winning does not depend on whether ads are watched.
- Each person may use only one account or entry.
- Employees of the Organiser and their relatives cannot win prizes.
3. Giving items away
This feature is not yet available and will follow in a later update. Sections 3, 6 and 7 apply once it is enabled.
- Participants can add their own items to the box with a photo, a name and a pickup location (the "Donor"). The item is given away, not sold.
- The Donor confirms that the item belongs to them, is free of third-party rights, matches the photo and may be handed over.
- Every item is checked before it goes live. The Organiser may reject or remove items without giving reasons.
- In particular, the following are not allowed: weapons, ammunition, fireworks, alcohol, tobacco, e-cigarettes, drugs, medicines, live animals, unpackaged food, counterfeits, stolen goods, adult content, and personal vouchers, tickets or accounts.
- Vehicles and items worth more than [€500] only after separate agreement with the Organiser.
4. Vouchers and gift boxes
- The box contains visible voucher cards and gift boxes. Only one of the gift boxes holds a voucher, the others are empty. An empty box wins nothing.
- The Organiser announces before the start of each month which vouchers and prizes will be awarded.
- Vouchers from partner companies are offered with their consent. The respective company's terms apply to redemption. Vouchers cannot be exchanged for cash.
5. Prize code and prize draw
- Anyone who drops a voucher, gift box or item into the chute plays a "Dots & Lines" duel against the computer for it.
- If the participant wins the duel, they receive a prize code. If they lose, they can use game coins for a second chance at the slot machine. Reaching the top step of the risk ladder also earns a prize code.
- The prize code must be emailed to [email protected] within [30 days]. By sending it, the participant enters the draw for that prize.
- The draw takes place [monthly on the last Sunday]. For each prize, one winner is drawn at random from all valid codes received. A prize code alone is not yet a prize.
- Winners are notified by email and must accept the prize within [7 days]; otherwise a new winner is drawn.
- There is no entitlement to a cash payment or exchange of the prize.
6. Handing over donated items
- Winner and Donor agree between themselves, ideally in the DuelFriends chat, whether the item is collected or posted. The winner pays postage unless agreed otherwise.
- The Organiser only connects people. It is not a party to the handover and never becomes the owner of the item.
- If the Donor does not respond within [14 days] or refuses the handover, they will be blocked. If the winner does not respond within [14 days], a new winner is drawn.
- We recommend meeting in a public place for pickups.
7. Voluntary thank-you bonus for donors
- The Organiser may pay donors a thank-you bonus after a successful handover. Whether it does so, and how much, is entirely its decision. There is no legal entitlement.
- The Donor is responsible for any tax on the bonus.
8. Exclusion and fraud
- The Organiser may exclude participants and withdraw prizes if they use several accounts, forge or pass on codes, use technical tricks, give false information or break these rules.
- If a criminal offence is suspected, the Organiser may inform the authorities.
9. Liability
- The Donor alone is liable for the condition and handover of donated items.
- The Organiser has unlimited liability for intent, gross negligence and injury to life, body or health. Otherwise liability is excluded as far as the law permits.
- The Organiser may end or change the game for good reason. Prizes already drawn remain valid.
10. Privacy
- The game state (game coins, codes, own items) is stored only on the participant's device.
- For the prize draw, the codes sent by email and the email address are processed and deleted after the draw unless there is a legal duty to keep them.
- More information: privacy policy.
11. Final provisions
- Google and Apple are not sponsors of this prize draw and are not involved in it in any way.
- Recourse to the courts regarding the selection of winners is excluded. Participants' statutory rights remain unaffected.
- German law applies. Mandatory consumer protection rules of the participant's country of residence remain unaffected.
- If any provision is invalid, the remaining provisions remain valid.
